Please read these Terms of Service carefully before using the services provided by Tech MEP Estimates. By engaging our services, you agree to be bound by these terms.
1. Services
Scope of Services
Tech MEP Estimates provides professional construction cost estimating services including mechanical (HVAC), electrical, plumbing, fire protection, general contractor, and specialty subcontractor estimates. Our estimates are prepared based on the information, drawings, and specifications provided by the client.
Estimate Accuracy
While we strive for maximum accuracy, all estimates are based on current market conditions, the information provided, and professional judgment. Estimates are not guaranteed bid prices. Actual costs may vary due to market fluctuations, site conditions, contractor overhead and profit markups, and other factors beyond our control.
2. Client Responsibilities
Information Provided
The client is responsible for providing accurate, complete, and current drawings, specifications, and project information. Tech MEP Estimates is not liable for errors in estimates resulting from incomplete, inaccurate, or misleading information provided by the client.
Plan Review
The client is responsible for reviewing all submitted documents before transmitting them to Tech MEP Estimates and for notifying us of any changes or clarifications during the estimating process.
3. Payment Terms
Fees
Service fees are agreed upon prior to commencement of work. A quote will be provided based on project scope, complexity, and turnaround time requirements. Fees are non-refundable once the estimating work has been completed and delivered.
Payment
Payment is due upon delivery of the completed estimate unless otherwise agreed in writing. Tech MEP Estimates reserves the right to withhold delivery of estimates until payment is received for clients with outstanding balances.
4. Turnaround Time
Delivery Schedule
We target 24–48 hour turnaround for standard estimates. Turnaround times are estimates based on workload and project complexity and are not guaranteed delivery dates. We will communicate proactively if any delays are anticipated. Rush delivery may be available for an additional fee.
5. Intellectual Property
Ownership of Estimates
Upon full payment, the client receives a license to use the delivered estimate for the specific project for which it was prepared. Tech MEP Estimates retains the right to use anonymized estimate data for internal benchmarking and quality improvement purposes.
Client Materials
The client retains ownership of all drawings, plans, and specifications submitted to Tech MEP Estimates. We will not use, reproduce, or distribute client materials except as necessary to provide our services.
6. Confidentiality
Mutual Confidentiality
Tech MEP Estimates treats all client project information as strictly confidential. We will not disclose project details, plans, or pricing information to any third party without the client's written consent. We are happy to execute a mutual Non-Disclosure Agreement (NDA) upon request.
7. Limitation of Liability
Liability Cap
Tech MEP Estimates' liability to the client for any claim arising out of or related to our services shall not exceed the fees paid for the specific estimate that gave rise to the claim. We are not liable for any indirect, incidental, consequential, or punitive damages.
No Warranty
Our estimates are provided 'as is' based on available information. We make no warranty that estimates will match final bid prices, contractor quotations, or actual project costs.
8. Revisions
Revision Policy
One round of revisions is included with each estimate for scope clarifications or minor changes to the original documents. Revisions resulting from significant scope changes, revised drawings, or new project information may be subject to additional fees.
9. Cancellation
Cancellation by Client
If the client cancels an order after work has commenced, a pro-rated fee will be charged for work completed to date. Cancellation requests must be submitted in writing to info@techmepestimates.com.
10. Governing Law
Jurisdiction
These Terms of Service shall be governed by and construed in accordance with applicable law. Any disputes arising under these terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.
11. Changes to Terms
Updates
Tech MEP Estimates reserves the right to update these Terms of Service at any time. Updated terms will be posted on this page with a revised date. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
